'The Initial Negative Market Value in the Investment Advisory' In 2011 the XIth Senate of the German Federal Court of Justice (BGH) decided in the famous 'Ille' case that the advising bank had to disclose any initial negative market value built into a CMS Spread Ladder Swap. Since then Banks' obligations concerning the disclosure of the initial negative marktet value have attracted considerable attention in Germany. The legal discussion has not ended yet. Object of this scientific work is the initial negative market value in terms of both fact and law.

Christian Sandquist studierte Rechtswissenschaften an der Albert-Ludwigs-Universität Freiburg und legte dort im Frühjahr 2012 sein erstes Staatsexamen ab. Anschließend absolvierte er das Rechtsreferendariat am Oberlandesgericht Düsseldorf, welches er Ende 2014 erfolgreich mit dem zweiten Staatsexamen abschloss. Während der Erstellung seiner Dissertation war er als Lehrkraft für Arbeitsgemeinschaften und als Co-Leiter der Examensberatung und Klausurklinik an der Juristischen Fakultät der Heinrich-Heine-Universität Düsseldorf tätig.
